PRIVACY AND DATA PROTECTION POLICY

In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, repealing Directive 95/46/EC (hereinafter, GDPR) of Law 34/2002 of 11 July, services of the information society and electronic commerce (hereinafter LSSI-CE) and Organic Law 3/2018, protection of Personal Data and guarantee of digital rights (hereinafter, LOPDGDD), Hotel Association of Capdepera guarantees the protection and confidentiality of personal data, of any kind provided to us by our customers, in accordance with the provisions of the General Regulation on the Protection of Personal Data. 

The data provided will be processed in the terms established in the GDPR, in this sense Asociación Hotelera de Capdepera has adopted the levels of protection that are legally required, and has installed all the technical measures at its disposal to prevent the loss, misuse, alteration, unauthorized access by third parties, set out below. However, the user should be aware that security measures on the Internet are not impregnable.

Purpose of the processing

All the data provided by our customers and / or visitors on the website of Asociación Hotelera y Servicios Capdepera or its staff, will be included in the register of activities of processing personal data, which is created and maintained under the responsibility of Asociación Hotelera de Capdepera, essential to provide the services requested by users, or to solve the doubts or questions raised by our visitors. Our policy is not to create profiles of our service’s users.

Legitimacy of treatment

  1. Contractual Relationship: This applies when you purchase one of our products or contract any of our services.
  2. Legitimate interest: To respond to the inquiries and complaints you raise and to manage the collection of monies owed.
  3. Your consent: If you are a user of our website, by ticking the box on the contact form, you authorize us to send you the necessary communication to respond to the query or request for information posed.

Recipients

We do not transfer your personal data to anyone except those public or private entities to which we are obliged to provide it, in connection with compliance with any law. To give an example, the Tax Law requires the Tax Agency to provide certain information on economic transactions exceeding a certain amount.

Retention

We will only retain your personal data for as long as necessary to achieve the purposes for which it was collected. When determining the appropriate retention period, we examine the risks involved in the processing, as well as our contractual, legal and regulatory obligations, internal data retention policies and our legitimate business interests described in this Privacy Notice and Cookies Policy.

In this sense, Asociación Hotelera de Capdepera will keep the personal data after the end of its relationship with you, completely blocked during the limitation period of the actions that may arise from the relationship with the interested party.

Once blocked, your data will be inaccessible to Asociación Hotelera y Servicios Capdepera, and will not be processed except for its availability to public administrations, judges and courts, for the attention of possible responsibilities, such as the exercise and defence of complaints before the Spanish Data Protection Agency.

Security

We use all the reasonable efforts to maintain the confidentiality of the personal information in our systems. We maintain strict levels of security to protect the personal data we process from accidental loss and unauthorized access, processing or disclosure, taking into account the state of technology, nature and risks to which the data is exposed. However, we cannot be responsible for your use of the data (including username and password) you use on our website. Our staff follows strict privacy rules and in the event of us hiring third parties to provide support services, we require them to follow the same rules and allow us to audit them to verify compliance.

  6. Right to the portability of your data, when the legal basis that enables us to process it, is in the existence of a contractual relationship or your consent.
  7. Right to revoke the consent granted to Asociación Hotelera y Servicios Capdepera.

In event that you think that your rights have been neglected by our entity, you can make a complaint in the Spanish Data Protection Agency, through one of the following means:

There is no cost to make a complaint with the Spanish Data Protection Agency and there is no need for a lawyer or legal assistance.

Updates

Hotel Association of Capdepera reserves the right to modify this policy to adapt it to new legislatives or jurisprudences that may affect compliance with it.
